Relationship to other terms
These draft Terms are intended to operate as the public website and early-access terms for Ember Cover. When paid subscriptions launch, a final Terms of Service, Cover Policy, Privacy Policy, and Subscription & Billing Terms will govern the live product.
If final published terms conflict with this draft, the final published terms will govern. If an onchain subscription, wallet-registration record, cover decision, or claim record identifies a dated terms version, that dated version is expected to control the corresponding event, subject to final counsel-approved terms.
What Ember Cover provides
Ember Cover is designed to review supported Solana transactions before signing, return a public cover status, and attach cover when a transaction is eligible under the applicable Cover Policy.
The current website lets users request the Ember install link, request devnet package instructions, and lets wallets, dApps, agent platforms, teams, and other partners request a conversation. The access form does not itself install the extension, create live cover, start a paid subscription, connect a wallet, or create a payout obligation.
The planned user product is the Ember Chrome extension wallet. Ember Cover may provide transaction review, cover status, evidence records, claim intake, subscription status, and partner integration support. Exact availability, supported wallets, supported networks, supported subscription plans, and supported transaction types may change before launch.
What Ember Cover does not provide
Ember Cover is not a wallet custody provider, broker, exchange, investment adviser, trading adviser, tax adviser, recovery service, or seed phrase storage service.
Ember does not take custody of your private keys, seed phrase, recovery phrase, or wallet. Do not submit private keys, seed phrases, passwords, recovery phrases, mainnet funds, or other secrets through the website, access form, partner form, or devnet package request.
Unless final binding terms state otherwise, Ember Cover does not guarantee asset recovery, market performance, protocol safety, transaction success, or that a transaction shown in a wallet will be eligible for cover.
Extension wallet and registration
The planned V2 subscription model is wallet-first. The wallet address that accepts an Ember Solana Subscription Plan is expected to operate as the billing identity and the primary covered wallet identity unless final terms allow additional wallet registration.
Wallet registration may require a wallet challenge, signature proof, Solana Subscription Plan evidence, subscription PDA, plan PDA, or Sign-In with Solana style authorization so Ember can bind future cover records to the correct wallet.
Registering a wallet or approving a subscription does not transfer ownership of the wallet to Ember and does not authorize Ember to sign transactions on the subscriber's behalf. A Solana Subscription Plan authorizes only the payment collection allowed by the approved plan terms.
Pre-sign review requirement
A transaction must be reviewed by Ember before signing and marked as covered for cover to attach. There is no retroactive cover for transactions Ember did not review and back before approval.
If Ember cannot understand a transaction, cannot support the transaction type, or is unavailable, the wallet may still work, but that transaction may not receive new cover.
A warning, simulation result, unsupported status, not-covered status, unavailable status, or access-list submission is not a promise of reimbursement.
Access requests
Submitting the access form authorizes Ember to contact you about product availability, subscription access, partner integrations, and supported Solana cover.
Submitting a form does not guarantee access, eligibility, cover, reimbursement, a subscription, devnet package approval, production distribution, or a commercial relationship.
Devnet packages, if provided, are for testing only and must not be used with mainnet funds, production wallets, or assets the tester cannot afford to lose.
Partner requests
The business page and partner request form are for wallets, dApps, agent platforms, teams, treasuries, and other product operators that want to discuss a potential Ember integration.
Submitting a partner request does not create exclusivity, certification, distribution rights, revenue-share rights, integration approval, or authority to advertise Ember Cover availability.
Any partner integration, certification, commercial terms, data-sharing terms, or wallet/dApp marketing approval must be agreed separately in writing.
Acceptable use and fraud controls
You may not use Ember Cover to submit fraudulent claims, create false records, manipulate eligibility, register wallets you do not control, evade sanctions or legal restrictions, probe the cover engine abusively, or interfere with the website or service.
Ember may decline, suspend, or terminate access where it reasonably suspects fraud, abuse, sanctions risk, security risk, legal non-compliance, or misuse of the access or partner forms.
Final terms may require identity, sanctions, wallet-control, or other verification before a paid subscription, claim review, or payout can proceed.
Availability and changes
The website, access forms, cover engine, partner integrations, supported Solana transaction types, and legal terms may change as Ember moves from draft access to paid subscriptions.
Ember may update, pause, remove, or decline access to any draft feature, devnet package, integration, form, or subscription flow where needed for security, legal compliance, product development, or operational reasons.
Draft disclaimers
The website is provided for early product information and access collection. It is not a final legal offer of cover, does not create a binding subscription, and does not promise that any specific transaction, wallet, asset, or loss will be covered.
To the maximum extent permitted by applicable law and subject to final counsel-approved terms, Ember's liability for any covered transaction event is expected to be limited to the applicable cover cap and final claim approval process.
